Welcome to Moon App, developed and owned by Roman Mahda ("we", "our", or "us"). These Terms of Use ("Terms") govern your use of the Moon App for iPhone and Apple Watch ("the App"). By using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, please discontinue using the App.

If you downloaded the App from the Apple App Store, Apple's Licensed Application End User License Agreement also applies. Apple is not responsible for the App or its content.

1. Overview

Moon App helps you understand and improve your sleep using Apple Health (HealthKit): sleep analysis, alarms with wake-up tasks, naps, Sleep Correction programs, sleep sounds, the Moon AI assistant, achievements, and social features — sleep challenges and shared alarms with friends.

The App is designed for personal, non-commercial use.

2. Eligibility

You must be at least 13 years old to use Moon App.
If you are under 18, you must have the consent of a parent or guardian.
By using the App, you confirm that you meet these requirements.

3. Your account

An account is optional. Some features — challenges, shared alarms and the referral program — require you to Sign in with Apple.

You are responsible for activity on your account and for keeping your device secure.
Your username, display name and profile photo must follow the community rules in section 4.
You can delete your account at any time in the App (Profile → Your Profile → ⋯ → Delete account). What is deleted and what is kept is described in the Privacy Policy.

4. Community rules

Social features let you share content with other users: your username, display name, profile photo, challenge and alarm titles, custom affirmations, and reactions. You are responsible for the content you share.

We have zero tolerance for objectionable content and abusive users. You must not post or share content, or behave in a way, that:

is sexual, violent, hateful, discriminatory or otherwise offensive;
harasses, bullies, threatens or impersonates anyone;
is spam, advertising, or misleading;
infringes someone else's rights or breaks the law.

You can report a user or block them from their profile. We review reports and aim to respond within 24 hours by removing objectionable content and, where appropriate, suspending or removing the account that posted it. We may also remove content or restrict accounts on our own initiative when they break these Terms.

5. Use of the App

By using Moon App, you agree to:

Use it only for lawful and personal purposes.
Not copy, reverse-engineer, decompile, or modify the App.
Not interfere with its functionality, integrity, or security, or try to get around usage limits.
Not create accounts or invitations in bulk, or abuse the referral program.

6. Alarms and shared alarms

Alarms use Apple's AlarmKit and require iOS 26 or later. Whether an alarm sounds depends on your device, its settings, battery and iOS itself. We work hard to make alarms reliable, but we cannot guarantee that every alarm will sound. Do not rely on Moon as your only alarm when missing it could cause harm.

In shared alarms, other participants can see your wake-up status for each morning, as described in the Privacy Policy. The owner of a shared alarm can change it for everyone, remove participants, or cancel it. You can leave a shared alarm at any time.

7. Health and AI disclaimer

Moon App provides informational insights only and is not a medical device. The App does not diagnose, prevent, or treat any medical condition. Always consult a qualified medical professional for advice regarding your sleep or health.

Moon AI responses are generated by artificial intelligence (OpenAI) and are for general informational purposes only. They can be inaccurate and should not be considered professional medical guidance. Moon AI is used only with your permission, which you can withdraw at any time.

The information provided by Moon App is for general wellness purposes only, consistent with Apple's HealthKit and App Store guidelines.

8. Subscriptions and payments

Moon App offers auto-renewable subscriptions through the Apple App Store.

Plans

Free: up to 5 alarms; Moon AI — 5 messages per week and 3 short voice messages per week; the "Rotation" wake-up task; join 1 shared alarm; up to 2 active challenges.
Premium: up to 10 alarms; Moon AI — 25 messages and 15 voice messages per day; all wake-up tasks (Light, Math, Steps, Affirmations); Sleep Correction; weekly reports with AI insights; create shared alarms and be in up to 3; up to 10 active challenges.
Premium+: everything in Premium, plus up to 20 alarms; Moon AI — 60 messages and 30 voice messages per day with longer messages and recordings; be in up to 5 shared alarms; priority support.

Plans are offered monthly and yearly. Prices depend on your country and currency and are shown in the App Store before you buy. Features and limits may change over time; changes are described in the App.

Auto-renewal

Payment is charged to your Apple ID account when you confirm the purchase.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
You can manage or cancel your subscription at any time in Settings → Apple ID → Subscriptions.
If a free trial or introductory offer is available, any unused part of it is forfeited when you buy a subscription.

Upgrades and downgrades

Upgrading to a higher plan takes effect immediately, with a prorated credit from Apple for the unused part of your previous plan.
Downgrading takes effect at the end of the current billing period.

Refunds

Refunds are handled by Apple under its refund policy. We do not process payments and do not store financial or billing information.

9. Referral program

You can invite friends with your personal referral link.

If a friend joins Moon through your link and buys a qualifying yearly subscription within 30 days, you receive a reward — currently 3 months of Premium — as an App Store offer code after a short verification period.
The invited friend gets a discount on the first year of a qualifying subscription (currently 50%), shown in the App Store before purchase.
A reward is not issued, or may be withdrawn, if the purchase is refunded or if we detect abuse (for example, self-referrals or fake accounts).
Rewards have no cash value and cannot be exchanged. We may change or end the referral program at any time; rewards already earned will be honored.

10. Third-party services

Moon App uses:

Apple — Apple Health, Sign in with Apple, AlarmKit, App Store purchases.
Google (Firebase) — accounts, cloud storage for social features, push notifications, analytics and audio content.
OpenAI — the Moon AI assistant and speech-to-text, only with your permission.

Each service has its own terms and privacy policies:

11. Suspension and termination

We may suspend or terminate your access to social features or your account if you break these Terms, in particular the community rules. You may stop using the App and delete your account at any time.

12. Limitation of liability

To the fullest extent permitted by law:

The App is provided "as is" and "as available", without warranties of any kind.
We do not guarantee that the App will be error-free, uninterrupted, or meet all your expectations, or that every alarm will sound.
We are not liable for any indirect, incidental, special, or consequential damages resulting from your use of the App.
You use the App entirely at your own risk.

Nothing in these Terms limits rights you have under mandatory consumer protection law.

13. Intellectual property

All trademarks, content, designs, icons, sounds and code within Moon App are the intellectual property of Roman Mahda or its licensors. You may not copy, reproduce, or distribute any part of the App without written permission.

14. Changes to these Terms

We may update these Terms at any time. When updated, the "Effective Date" will change, and for significant changes we will let you know in the App. Your continued use of the App after such updates means you accept the new Terms.

15. Governing law and jurisdiction

These Terms are governed by the laws of Ukraine. Any disputes arising under or related to these Terms will be resolved under Ukrainian jurisdiction, without prejudice to mandatory rights you have where you live.
